1. About these terms

1.1. These Terms & Conditions ("Terms") explain what Tripcum ("the Site", "we", "us") offers and the rules that apply when you visit or use it. By opening, browsing, registering on, or publishing anything to the Site, you accept these Terms in full. If you do not accept them, do not use the Site.

1.2. The Site is strictly for adults. No person under 18 years of age may visit, register, advertise, or otherwise use the Site, and no content on the Site may involve or depict anyone under 18 in any context.

1.3. These Terms are the whole agreement between you and Tripcum about your use of the Site. They replace any earlier statements, discussions, or understandings, whether written or spoken.

2. What Tripcum is — and what it is not

2.1. Tripcum operates an online directory in which independent adult advertisers publish profiles and in which businesses may purchase sponsored placements. The Site's paid services — profile activation plans, sponsored placements, wallet top-ups, and coupons — are advertising services. Payment to Tripcum buys advertising visibility and nothing else.

2.2. Tripcum does not arrange introductions, take bookings, schedule appointments, negotiate rates, handle money between users, or participate in any way in what advertisers and visitors agree between themselves. Tripcum is not an escort agency, broker, employer, or representative of any advertiser, and no advertiser acts on Tripcum's behalf.

2.3. Profile content — text, photographs, video, rates, services, contact details, and availability statements — is created and supplied by the advertiser alone. Publication of a profile or placement is not an endorsement. Tripcum does not promise that any advertiser is verified, safe, available, accurately described, or suitable, and paid tiers or placements never mean that an advertiser has been vetted beyond the moderation described in these Terms.

2.4. You deal with advertisers at your own risk and on your own judgment. Any arrangement, activity, or exchange between you and an advertiser is a private matter between consenting adults.

3. Accounts and security

3.1. Advertisers register an account to publish profiles or purchase placements. You must provide accurate information when registering and keep it current.

3.2. Your login credentials are personal and confidential. You are responsible for everything done through your account. Tell us promptly if you suspect someone else has accessed it.

3.3. Some parts of the Site are restricted to registered users, to advertisers, or to Tripcum staff. We may limit, suspend, or close access to any part of the Site, for any user, at our discretion — for example after a breach of these Terms, a legal requirement, or a report that requires investigation.

4. Your content and our materials

4.1. Tripcum and its licensors own the Site itself: its design, software, databases, logos, and the materials we create. We give you a limited, non-transferable permission to view the Site for its intended personal use. That permission does not extend to copying, republishing, selling, licensing, publicly displaying, or exploiting any part of the Site or another user's content.

4.2. You keep ownership of the content you submit — your photographs, video, audio, and text. When you submit content, you give Tripcum a worldwide, non-exclusive, royalty-free permission to host, store, reproduce, resize and reformat, translate, display, and distribute that content on the Site and in promoting the Site, for as long as the content is published. This permission ends when you delete the content or close your account, except for backup copies that expire in the ordinary course, content already removed at the request of authorities, and records we must keep by law.

4.3. You may only submit content that belongs to you or that you are fully entitled to use, and your content must not infringe anyone's copyright, privacy, publicity, or other rights. If your content shows another identifiable person, you confirm that person is an adult who has given informed permission to be shown. The Acceptable Content & Advertising Policy forms part of these Terms.

4.4. We may remove, hide, or refuse any content at any time, without notice, including where content breaches these Terms, is the subject of a complaint or legal demand, or exposes Tripcum or its users to risk.

5. Acceptable use

5.1. You must not, in connection with the Site:

• reproduce, republish, sell, rent, sublicense, or otherwise exploit Site material or another user's content;
• scrape, crawl, harvest, mine, or bulk-collect profiles, images, contact details, or any other Site data, by automated means or otherwise;
• use the Site for unsolicited marketing, spam, or advertising of services unrelated to your own published profile;
• probe, disrupt, overload, or interfere with the Site, its security, or other users' access;
• misrepresent your identity, your age, or your connection to another person or business;
• transfer, sell, or share your account, or assign your rights or obligations under these Terms to anyone else.

5.2. You must not use the Site in any way that breaks an applicable law or regulation, that harms or could harm any person or business, or that damages the Site's operation or reputation. You are personally responsible for complying with the laws that apply to you, wherever you are.

6. Rules for advertiser content

6.1. Every person shown, described, or contactable through advertiser content must be a living adult of at least 18 years, participating voluntarily. Content involving, suggesting, or sexualizing minors in any way is prohibited absolutely and will be removed and reported to the appropriate authorities.

6.2. Content must not involve or promote coercion, trafficking, exploitation, blackmail, violence, or any service a person is forced to provide. Content must not advertise on behalf of a third party who has not authorized and does not control their own advertising.

6.3. Advertisers are responsible for the truthfulness of what they publish and for keeping their profiles lawful under Kenyan law and the laws of anywhere their advertisement can be acted on.

6.4. Tripcum operates moderation and a report/takedown process. We may reject, suspend, or remove profiles, media, or sponsored content that breaches these rules, and we may suspend or close the accounts responsible. Repeated or serious breaches may lead to permanent removal. The Reporting, Takedown & Appeals Policy explains how reports and appeals are handled.

7. Paid advertising services

7.1. Advertisers may buy profile activation plans of fixed durations, reserve sponsored placement slots, top up a prepaid wallet balance, and redeem coupons. All of these are advertising services. No payment to Tripcum ever buys, prices, reserves, or relates to any meeting or activity between users.

7.2. Prices, durations, allowances, and placement availability are shown at the point of purchase and may change for future purchases. A confirmed payment activates only the advertising service described at purchase.

7.3. Wallet balances are prepaid advertising credit held in Kenyan shillings. Balances are personal to the account, cannot be transferred between users, and are not a bank deposit, investment, or stored monetary value for any other purpose.

7.4. Moderation, suspension, takedown, or expiry can interrupt the display of paid advertising. Cancellations, refunds, account credit, failed payments, and lost display time are governed by the Paid Advertising, Cancellation & Refund Policy shown before purchase. Nothing in these Terms limits a right that applicable consumer law does not allow us to exclude.

7.5. Sponsored placements are always labelled as paid advertising and pass content moderation before and during display.

8. No warranties

8.1. The Site and everything on it are provided "as is" and "as available". Tripcum makes no promises or representations of any kind about the Site, its availability, its accuracy, or the material users publish on it.

8.2. Nothing on the Site is advice — legal, medical, financial, safety, or otherwise — and you should not treat it as such.

9. Limitation of liability

9.1. To the fullest extent the law allows, Tripcum, its directors, employees, and agents accept no liability for anything arising from or connected to your use of, or inability to use, the Site. This covers indirect, consequential, special, and contractual losses, and includes anything that happens between you and an advertiser or any other user.

9.2. Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Indemnity

10.1. You agree to cover Tripcum against claims, losses, damages, costs, and expenses (including reasonable legal costs) that arise from your breach of these Terms, from your content, or from your unlawful use of the Site.

11. Changes, transfer, and severability

11.1. We may update these Terms. We will identify the effective version and require registered advertisers to accept a materially changed required version before they can publish content or buy more advertising. Changes do not apply retroactively unless the law requires it.

11.2. We may transfer, subcontract, or assign our rights and obligations under these Terms without notice, for example in a restructuring or sale of the business.

11.3. If a clause of these Terms is found invalid or unenforceable under an applicable law, that clause is removed or limited only as far as necessary; the rest of the Terms continue in full force.
